In consideration of your participation in our courses or any services provided by us, you hereby waive and release us from any and all responsibility or liability for injuries or damages resulting from your participation.
Nothing in these terms shall exclude or limit liability for (i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the United Kingdom.
Miscellaneous
You must declare any relevant conditions that you have prior to the commencement of a course or any other service provided by us, including, in particular, any serious mental health condition, epilepsy, heart condition or asthma. You may be requested to inform or seek consent from your GP or other medical practitioner and, where this is relevant, you must agree to do so before commencing a course or the use of a service by us.
Any health-related or medical information you disclose will not generally be disclosed to others. However, there may be times that a disclosure needs to be made to protect your health and welfare or the health and welfare of others or to comply with the law. Where this is necessary, we will discuss this with you.
Cancellation
In the event you are unable to attend a course, and provided your cancellation is received in writing at least 30 days prior to the first session of the course, we will refund in full minus any administration charge (if applicable), or it may be mutually agreed, to move your date to a future date that the course is available. Refunds will not be offered, and courses will not be transferred to other course dates if your cancellation is received less than 30 days prior to the first session, or once the course starts.
Termination and Suspension
We may suspend or terminate your access to and use of our services (or any portion thereof) at any time without notice if we believe that any activity or use of our services in connection with your account or registration violates these terms, the intellectual property rights of a third party or applicable laws, or if we are required to do so by law.
We reserve the right to withdraw a course or any other service provided by us, at any time, and, where this is necessary, you will be given as much notice as possible. You will receive a proportionate refund for any course or any other of our services that has been withdrawn, minus any fees that we have incurred.
Governing Law and Dispute Resolution
These terms shall be governed by and construed in accordance with English law. If you have any dispute with us arising out of or relating to these terms, you agree to notify us in writing with a brief written description of the dispute and we will have thirty (30) days from the date of receipt within which to attempt to resolve the dispute to your reasonable satisfaction. If we are unable to resolve the dispute through good faith negotiations over such thirty (30) day period under this informal process, either party may pursue resolution of the dispute arising in connection with these terms, subject to the exclusive jurisdiction of the courts of England and Wales.
